Ninth Circuit Rejects ADA Appeal
After five years of litigation against Delta Air Lines, Stone & Woodrow won a 1.8 million jury award for an aircraft mechanic who was fired due to his HIV. Delta appealed to the Ninth Circuit on a number of points and lost all but their attack on the attorney fee portion of the award.
On remand, the District Court judge, in an affirmation of attorneys taking risks for people in need, preserved 99% of the original award.
Delta then challenged the appellate attorney’s fees and was equally unsuccessful, ultimately paying an additional six-figure amount
